These Terms & Conditions ("Terms") govern your use of the WarrantyARK iOS application ("the App") and the warrantyark.com website ("the Site"), both provided by WideLabs GmbH ("we", "us", "WideLabs").

By downloading, installing, or using the App, or by browsing the Site, you agree to be bound by these Terms. If you do not agree, please do not use the App or the Site.

2. License

When you purchase WarrantyARK from the Apple App Store, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices linked to your Apple ID, subject to Apple's Family Sharing rules and the Apple Media Services Terms of Service.

You may not redistribute, resell, sublicense, decompile, or reverse-engineer the App.

3. Purchase and refunds

WarrantyARK is sold via the Apple App Store at €3.99 as a one-time purchase. All payments, billing, and refund requests are handled by Apple. Refund eligibility is governed by Apple's policies — see Apple's refund policy. We do not process payments or refunds directly.

4. Acceptable use

You agree to use the App lawfully and for its intended purpose: tracking warranties, receipts and related documents for items you legitimately own or possess. You will not use the App to store or transmit illegal material.

5. Your content

Any data you enter into the App — descriptions, photos of receipts, notes — remains your property. We do not have access to it. For details on how the App handles your data, see our App Privacy Policy.

6. Disclaimer of warranties

The App and Site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

You are responsible for verifying the warranty information you record and acting on it within the applicable warranty periods. While we built WarrantyARK to help you not miss warranty claims, the legal responsibility for filing claims rests with you.

7. Limitation of liability

To the maximum extent permitted by Swiss law, WideLabs GmbH and its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, business opportunities, or warranty claim opportunities — arising out of or in connection with your use of the App or the Site, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you, regardless of the cause of action, shall not exceed the amount you paid for the App (€3.99).

8. Third-party services

The App runs on Apple iOS and may integrate with Apple's iCloud service if you enable it. Use of those services is governed by Apple's own terms and privacy policy. Apple is not a party to these Terms and has no obligation to provide any support or maintenance for the App.

9. Updates

We may release updates to the App from time to time to fix bugs, improve features, or comply with platform requirements. Updates are distributed via the Apple App Store under your control.

We may also update these Terms periodically. Material changes will be communicated by posting the updated Terms on warrantyark.com with a revised "Last updated" date. Continued use of the App or Site after such changes constitutes acceptance of the revised Terms.

10. Termination

You can terminate this agreement at any time by deleting the App from your devices. We may terminate or restrict your license if you materially breach these Terms, or if we discontinue the App entirely. Termination does not entitle you to a refund unless required by applicable law or Apple's refund policies.

11. Intellectual property

The WarrantyARK name, logo, App design, source code, and marketing materials are the intellectual property of WideLabs GmbH and are protected by Swiss and international copyright and trademark laws. Nothing in these Terms grants you any rights to use our trademarks, logos, or brand assets without prior written permission.

12. Governing law and jurisdiction

These Terms are governed by the laws of Switzerland, excluding its conflict-of-laws provisions and excluding the United Nations Convention on Contracts for the International Sale of Goods.

Any dispute arising from these Terms or from your use of the App or Site shall be resolved exclusively by the competent courts in Zürich, Switzerland — except where mandatory consumer-protection law in your country of residence requires otherwise.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
